These Terms & Conditions apply to all bookings made with Sharon Jones trading as Cover Story Weddings and Events (“Cover Story”, “we”, “us” or “our”).
By accepting a quotation and paying the booking deposit, you (“the Client”, “you” or “your”) agree to these Terms & Conditions.
Please read them carefully before confirming your booking.
Nothing in these Terms & Conditions is intended to exclude or restrict any legal rights you may have as a consumer.
1. Definitions
In these Terms & Conditions:
“Client” means the person named on the quotation or booking confirmation.
“Cover Story”, “we”, “us” or “our” means Sharon Jones trading as Cover Story Weddings and Events.
“Event” means the wedding, party, celebration, corporate event or other occasion for which our services have been booked.
“Event Date” means the date stated on your booking confirmation.
“Services” means the venue dressing, event styling, décor hire, installation, collection, design and any other services agreed between Cover Story and the Client.
“Hire Items” means any décor, props, furniture, accessories, signage, backdrops, centrepieces, linens, florals or other items supplied by Cover Story on a hire basis.
“Booking Deposit” means 25% of the total agreed price, payable to secure the Event Date.
“Balance” means the remaining amount payable after deduction of the Booking Deposit and any other payments already made.
2. Quotations and Bookings
2.1
All quotations are subject to availability and are valid for the period stated on the quotation.
2.2
A quotation does not constitute a confirmed booking.
2.3
A booking is only confirmed once:
the Client has accepted the quotation;
the Client has agreed to these Terms & Conditions; and
the 25% Booking Deposit has been received by Cover Story.
2.4
Once the Booking Deposit has been received, Cover Story will reserve the Event Date for the Client and the Client acknowledges with the Deposit payment that these Terms and Conditions have been read and accepted.
2.5
The person named on the booking confirmation is responsible for the booking and for ensuring that all information supplied to Cover Story is accurate.
Where more than one person is named as Client, each Client will be jointly responsible for the obligations under these Terms & Conditions.
3. Booking Deposit
3.1
A 25% Booking Deposit is required to secure the Event Date.
3.2
The Booking Deposit will be deducted from the total price of the booking.
3.3
The Booking Deposit is intended to compensate Cover Story for reserving the Event Date, turning away other enquiries that clash with the time for that date and beginning work associated with the booking.
3.4
The Booking Deposit is generally non-refundable if the Client cancels the booking, subject to the cancellation provisions contained in these Terms & Conditions and any rights the Client has under applicable consumer law.
3.5
If Cover Story is able to re-book the Event Date and thereby substantially reduce its loss following a Client cancellation, Cover Story may, at its discretion, take this into account when determining any refund due.
4. Payment
4.1
The total price for the Services will be stated on the quotation or booking confirmation.
4.2
The 25% Booking Deposit is payable when the booking is made.
4.3
The remaining balance must be paid in full no later than 28 days before the Event Date.
4.4
The final payment deadline will be stated on the final invoice where appropriate.
4.5
Cover Story may issue a reminder before the final payment deadline, but the Client remains responsible for ensuring that payment is made on time.
4.6
If full payment has not been received by the required date, Cover Story will contact the Client to request payment.
If payment remains outstanding, Cover Story may suspend preparation for the Event and/or treat the booking as cancelled by the Client, subject to applicable law and the cancellation provisions of these Terms & Conditions.
4.7
Cover Story reserves the right to recover reasonable costs and losses arising from late payment where legally permitted.
5. Changes to Your Booking
5.1
We understand that wedding and event plans can change.
The Client should notify Cover Story as soon as possible if they wish to make changes to their booking.
5.2
Changes to the Services, Hire Items, guest numbers, venue, timings or design may affect the total price.
5.3
Any additional Services or Hire Items requested after the original quotation has been accepted will be subject to availability and may incur additional charges.
5.4
Cover Story will confirm any agreed changes and associated additional charges in writing wherever reasonably possible.
5.5
Significant changes requested close to the Event Date may not be possible because stock, materials, staff, suppliers and preparation time may already have been committed.
5.6
Where a requested change results in a reduction in the Services or Hire Items, any reduction in price will be considered on a case-by-case basis, taking into account costs already incurred and work already undertaken.
6. Final Details
6.1
The Client is responsible for providing Cover Story with accurate and complete information reasonably required to deliver the Services.
This may include:
venue details;
access information;
event timings;
room layouts;
table plans;
guest numbers;
colour schemes;
design requirements;
installation and collection times; and
venue contact details.
6.2
Cover Story may require final event details within a reasonable period before the Event Date.
6.3
If required information is not provided in sufficient time, Cover Story may not be able to accommodate late changes.
7. Venue Access and Responsibilities
7.1
The Client is responsible for ensuring that Cover Story has reasonable and safe access to the venue at the agreed installation and collection times.
7.2
The Client must obtain any permissions required from the venue for Cover Story to provide the Services.
7.3
The Client is responsible for ensuring that the venue permits the proposed decorations, fixings, candles, hanging items, furniture, florals, backdrops and other styling elements where applicable.
7.4
Cover Story is not responsible for delays caused by the venue, venue staff, other suppliers, guests or circumstances outside our reasonable control.
7.5
If Cover Story is unable to gain access to the venue at the agreed time, additional charges may apply where we incur additional travel, labour or other costs.
8. Installation and Collection
8.1
Installation and collection times will be agreed with the Client and/or venue where reasonably possible.
8.2
The Client acknowledges that installation and collection may take a significant amount of time depending on the size and complexity of the booking.
8.3
The Client must not require Cover Story to remove items before the agreed collection time unless otherwise agreed.
8.4
Where the venue or Client requires Cover Story to change agreed installation or collection times, additional charges may apply if this results in additional labour, travel or other costs.
9. Hire Items
9.1
All Hire Items supplied by Cover Story remain the property of Cover Story unless expressly stated otherwise.
9.2
Hire Items are supplied for the agreed Event and must not be removed from the venue or used for any other event without Cover Story's written permission.
9.3
Hire Items must not be moved, altered, dismantled, repaired, decorated or modified by the Client or guests unless Cover Story has given permission.
9.4
Where Hire Items are damaged, lost, destroyed or not returned as a result of the Client's or their guests' actions, Cover Story may charge the reasonable cost of repair, cleaning or replacement.
9.5
Any such charge will reflect the actual or reasonably estimated cost incurred by Cover Story.
9.6
The Client is not responsible for ordinary wear and tear.
10. Care and Use of Hire Items
The Client must ensure that:
Hire Items are used only for their intended purpose;
guests do not deliberately interfere with or misuse Hire Items;
children are appropriately supervised around Hire Items;
candles, flames and other potentially hazardous items are used only where permitted and in accordance with venue requirements;
Hire Items are not moved once installed without permission; and
no Hire Item is removed from the venue without Cover Story's permission.
Cover Story reserves the right to remove an item if it considers that continuing to use the item would create a safety risk or could result in significant damage.
11. Weather and Outdoor Events
11.1
Unless specifically agreed in writing, Services are intended for indoor use.
11.2
Where outdoor styling is agreed, the Client acknowledges that weather conditions may affect the availability or safe use of certain Hire Items.
11.3
Cover Story may refuse to install or may remove outdoor items where weather conditions create a reasonable risk of injury, damage or loss.
11.4
This may include, without limitation:
high winds;
heavy rain;
extreme temperatures;
lightning;
storms; or
other hazardous weather conditions.
11.5
Where an alternative safe arrangement can reasonably be provided, Cover Story will discuss this with the Client.
12. Substitution of Items
12.1
Cover Story will make reasonable efforts to provide the items specified in the Client's quotation.
12.2
Occasionally, an item may become unavailable because of damage, loss, supplier issues or circumstances outside our reasonable control.
12.3
Where this occurs, Cover Story may provide a reasonably similar alternative of comparable quality and value.
12.4
Where a suitable alternative cannot reasonably be provided, Cover Story will discuss the available options with the Client.
13. Third-Party Suppliers
13.1
Cover Story may use third-party suppliers or contractors where reasonably necessary to provide the Services.
13.2
Where third-party services are arranged as part of the Client's booking, Cover Story will take reasonable care in selecting appropriate suppliers.
13.3
Where the Client independently contracts with another supplier, Cover Story is not responsible for that supplier's acts, omissions, delays or failure to provide its services.
14. Cancellation by the Client
14.1
If the Client wishes to cancel the booking, cancellation must be made in writing by email to:

14.2
The date on which Cover Story receives the cancellation notice will be treated as the cancellation date.
14.3
Because Cover Story reserves the Event Date specifically for the Client and may incur costs in preparation for the Event, cancellation may result in Cover Story retaining some or all of the amounts paid or requesting payment of an amount reasonably reflecting its losses.
14.4
In assessing any amount retained or payable following cancellation, Cover Story will take reasonable account of:
work already carried out;
goods or materials purchased or ordered specifically for the Client;
third-party costs already incurred;
preparation and design work;
administrative and other reasonable costs;
the time reserved for the Event;
any loss of income arising from the cancellation; and
any amounts Cover Story is able to recover by re-booking the Event Date or otherwise reducing its losses.
14.5
Cover Story will not seek to recover the same loss twice.
14.6
Nothing in this section limits any cancellation or refund rights that the Client has under applicable consumer law.
15. Cancellation by Cover Story
15.1
Cover Story will only cancel a confirmed booking where there is a reasonable basis for doing so, including circumstances where:
the Client has seriously breached these Terms & Conditions;
payment remains substantially overdue;
providing the Services would create an unacceptable health or safety risk;
the venue is inaccessible or unsuitable and no reasonable alternative can be agreed; or
circumstances beyond our reasonable control prevent us from providing the Services.
15.2
Where Cover Story cancels a booking for a reason that is not the Client's fault and is not covered by the Force Majeure provisions, Cover Story will provide the Client with an appropriate refund of amounts paid for Services that have not been provided, subject to any rights and remedies available under applicable law.
15.3
Where reasonably possible, Cover Story will make reasonable efforts to help the Client find an alternative solution or date.
16. Force Majeure
16.1
Neither party will be responsible for a failure or delay in performing its obligations where that failure or delay results from circumstances beyond the reasonable control of the affected party (“Force Majeure Event”).
16.2
Force Majeure Events may include, without limitation:
natural disasters;
severe weather;
flooding;
fire;
serious accident;
epidemic or pandemic;
government restrictions or actions;
changes in law;
war or threat of war;
terrorism;
civil unrest;
industrial disputes;
strikes;
transport disruption;
serious illness or incapacity;
failure of essential utilities;
venue closure;
road closures;
significant supplier failure; or
other circumstances that could not reasonably have been prevented or overcome.
16.3
A Force Majeure Event does not automatically cancel the booking.
Where reasonably possible, Cover Story and the Client will work together in good faith to agree an alternative date or reasonable alternative arrangements.
16.4
Any alternative Event Date will be subject to Cover Story's availability and the availability of relevant suppliers, Hire Items and the venue.
16.5
Where an alternative date is agreed, amounts already paid will normally be transferred to the replacement booking, subject to any reasonable additional costs arising from the change.
16.6
If no reasonable alternative date can be agreed, Cover Story will consider the amounts paid and costs incurred on a fair and reasonable basis and in accordance with applicable consumer law.
16.7
Nothing in this Force Majeure clause is intended to remove or restrict any statutory rights the Client may have.
17. Health and Safety
17.1
Cover Story will take reasonable care when installing and arranging Hire Items.
17.2
The Client must inform Cover Story before the Event of any known venue restrictions, hazards or requirements that could affect the safe installation or use of the Services.
17.3
Cover Story may refuse to install an item or may alter an installation where we reasonably believe that doing so would create an unacceptable safety risk.
17.4
Hire Items must not be tampered with, moved or dismantled by guests.
17.5
Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence.
18. Liability
18.1
Cover Story will provide the Services with reasonable care and skill.
18.2
Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited.
18.3
Subject to the above, Cover Story will not be responsible for losses caused by circumstances outside our reasonable control.
18.4
Cover Story will not be responsible for damage resulting from the Client, guests, venue staff or third-party suppliers moving, altering or misusing Hire Items.
18.5
Where Cover Story is responsible for a loss, our liability will be assessed in accordance with applicable law and the circumstances of the particular claim.
18.6
Nothing in these Terms & Conditions affects the Client's statutory rights.
19. Complaints
19.1
We want every Client to be happy with our Services.
If you have a concern, please contact Sharon Jones as soon as reasonably possible so that we have an opportunity to investigate and, where appropriate, put matters right.
19.2
Complaints should preferably be made in writing to:

19.3
Where possible, concerns relating to the Services provided on the Event Date should be raised with Cover Story as soon as reasonably practicable, so that we have an opportunity to address the issue.
19.4
Nothing in this complaints procedure limits your statutory rights.
20. Photography and Use of Images
20.1
Cover Story may wish to photograph or video the décor and styling we have provided for our portfolio, website and social media.
20.2
We will take reasonable care to avoid identifying individuals where this is not necessary.
20.3
We will not knowingly use identifiable images of the Client or guests for marketing purposes where the Client has expressly asked us not to do so.
20.4
If you do not want images of your event or our work to be used for promotional purposes, please notify us in writing before the Event Date.
20.5
Any personal information contained in photographs will be handled in accordance with our Privacy Policy.
21. Intellectual Property and Design
21.1
Design concepts, proposals, mood boards, layouts, photographs and other original materials created by Cover Story remain the intellectual property of Cover Story unless otherwise agreed in writing.
21.2
The Client must not reproduce, copy or commercially use Cover Story's original designs, concepts or materials without our written permission.
21.3
This does not prevent the Client from using photographs of their own Event for personal, non-commercial purposes.
22. Venue Rules
22.1
The Client is responsible for complying with the rules and requirements of the venue.
22.2
Where venue requirements conflict with the proposed Services, Cover Story will work with the Client to find a reasonable alternative where possible.
22.3
Any additional costs caused by venue restrictions or requirements that were not known when the quotation was prepared may be payable by the Client, provided these costs are agreed where reasonably practicable.
23. Prices and Additional Charges
23.1
The agreed price will be stated on the quotation or booking confirmation.
23.2
Additional charges may apply where the Client requests additional Services, Hire Items, travel, installation time, collection time or other work not included in the original quotation.
23.3
Where an additional charge is foreseeable, Cover Story will communicate it to the Client before the additional work is undertaken wherever reasonably possible.
23.4
No additional charge will be made for an item or service that the Client has not agreed to, except where the charge arises from circumstances for which the Client is responsible and the charge is otherwise permitted by law.
24. Events at Private Residences
Where Services are provided at a private residence, the Client is responsible for ensuring that:
there is safe access to the property;
there is sufficient space for installation and removal;
any necessary permissions have been obtained;
pets are kept away from installation areas where appropriate; and
the installation area is reasonably safe and suitable.
Cover Story may decline to carry out an installation where the location presents an unreasonable health or safety risk.
25. Agreement and Acceptance
25.1
The quotation, booking confirmation, these Terms & Conditions and any agreed written amendments together form the agreement between the Client and Cover Story.
25.2
Payment of the Booking Deposit constitutes acceptance of these Terms & Conditions.
25.3
Where a written contract or booking form is signed by the Client, that signed document will also form part of the agreement.
25.4
If there is a conflict between the quotation and these Terms & Conditions, the specific written terms of the quotation will take precedence where they clearly relate to the particular booking.
26. Changes to These Terms & Conditions
26.1
Cover Story may update these Terms & Conditions from time to time.
26.2
The Terms & Conditions applying to a booking will normally be those provided to the Client at the time the booking is made.
26.3
We will not retrospectively change the terms of an existing booking in a way that materially disadvantages the Client without the Client's agreement.
27. Privacy
Personal information provided to Cover Story will be handled in accordance with our Privacy Policy.
Our Privacy Policy explains how we collect, use, store and protect personal information.
Our Cookie Policy explains how cookies and similar technologies are used on our website.

28. Governing Law
These Terms & Conditions and any contract between Cover Story and the Client are governed by the law of England and Wales.
Any dispute will be dealt with by the courts of England and Wales, subject to any mandatory consumer rights or jurisdictional protections that apply to the Client.
29. Statutory Rights
Nothing in these Terms & Conditions is intended to exclude, restrict or limit any statutory rights that the Client has under applicable UK law.
In particular, where the Client is a consumer, the Services will be provided with the rights and protections applicable under the Consumer Rights Act 2015 and other applicable consumer legislation.
